Terms of Service

Last updated: 7 November 2026

1. Who we are and what these terms do

These Terms of Service ("Terms") are between you and Zafre Media, the trading name of AL UMA ALRAQAMI COMPUTER SYSTEMS DESIGN ("Zafre", "we", "us", "our"), a sole establishment licensed by the Department of Economy and Tourism, Dubai, under trade licence no. 1183327, owned by Seyed Reza Mirhossein Movahedi, with its address at Plot 13-S1, Dubai Investment Park 1, Dubai, United Arab Emirates.

They cover two things: using our website at zafremedia.com, and buying website and booking-system services from us. By using the site, requesting a free homepage preview, or ordering a plan, you accept these Terms. If you do not accept them, do not use the site or order from us.

We contract with businesses, not consumers. By ordering, you confirm you are acting for a business and have authority to bind it.

Our Privacy Policy, Cookie Policy and Guarantee Terms form part of these Terms.

2. Definitions

  • Client — the business that orders a Plan.
  • Order — the proposal, quote or order form we send and you accept, naming your Plan, price and scope.
  • Plan — Starter, Booking System or Growth Plan, as described in section 3.
  • Preview — the free redesigned homepage described in section 4.1.
  • Project Start Date — the date we confirm in writing that your project has begun, after your first payment has cleared.
  • Content Complete Date — the date we confirm in writing that we have received everything listed in section 7.1 and have the access we need.
  • Launch — the date your site is published and reachable on your live domain.
  • Engagement — the 90-day period running from the Project Start Date.
  • Business Day — Monday to Friday, excluding public holidays in the UAE.
  • Deliverables — everything we produce or set up for you under an Order.

3. The Plans

We build websites and booking systems for local service businesses in a small number of selected industries. We work this way deliberately: we research an industry and prepare a site for it in advance, then adapt that site to the Client's brand, content, photographs, services and area. The Deliverables are built on our own pre-built industry templates, adapted for you — they are not a bespoke design built from a blank page, and we do not represent them as one.

  • Starter: A focused booking site: core pages, a one-tap booking flow, copy written for you, SEO-safe migration, the Booking Tracker dashboard, and a done-for-you launch. $1,200 founding, $1,500 regular. One project fee.
  • Booking System: Everything in Starter across the whole site (20+ pages), plus the Trust Builder Pack, Found Locally setup for your Google Business Profile, and the Booking Tracker dashboard with a monthly report for 90 days. $1,900 founding, $2,900 regular. One project fee.
  • Growth Plan: A monthly add-on to Booking System: AI-search readiness and visibility tracking, 2 new pages a month, weekly Google posts and a review engine, and a monthly growth call. $597 per month. 6-month minimum.

The price that applies to you is the one stated in your Order. Founding prices are a limited introductory rate, offered at our discretion and only while we say they are available; we may withdraw or change them at any time before you place an Order.

The exact contents of each Plan are as set out in your Order. Where your Order and this page differ, your Order wins.

3.1 Which guarantees apply

  • Starter carries the On-Time Launch Guarantee only.
  • Booking System and Growth Plan carry all three guarantees.

The triggers, remedies, conditions and limits are in our Guarantee Terms, which apply in full. Nothing on our website, in an advertisement, in a message or on a call extends a guarantee beyond what the Guarantee Terms say.

3.2 Growth Plan terms

The Growth Plan may be added to a Booking System engagement at any time. It runs for a minimum of 6 months from the date it starts, is billed monthly in advance, and continues month to month after the minimum until either of us gives 30 days' written notice.

Monthly fees are earned when the month begins and are not refundable in whole or in part, including for a month you cancel part-way through. The guarantees in our Guarantee Terms do not apply to Growth Plan monthly fees.

4. The free homepage preview

4.1 What it is

We may redesign your existing homepage and send it to you at no cost, with no obligation on you to buy anything. To build it we use material your business has already published — your website, your public business listing, your public reviews and photographs. We explain this in our Privacy Policy.

4.2 What it is not

  • It is not an offer we are bound to accept, a reserved project slot, or a promise that we will work with you.
  • It is a visual concept, not a working website. It may not be responsive on every device, may contain placeholder material, and is not optimised, tested or ready to publish.
  • You may view it, share it inside your business, and use it to decide whether to order. Until you order a Plan and pay the first instalment, the Preview and everything in it remains our property. You may not publish it, host it, hand it to another agency or developer, or use it as the basis for work by anyone else.
  • We may show the Preview, including a before-and-after comparison, as an example of our work, with your business's name, logo and identifying details removed or obscured. If you would rather we did not, tell us at hello@zafremedia.com and we will not.
  • If you tell us to delete the Preview and stop using your business's material, we will.

4.3 Capacity and regional exclusivity

We take on a limited number of new projects each month — currently 5 — and we work with one Client per industry per district. For this purpose a district means a named district or neighbourhood within a city, or a defined group of postal or ZIP codes, as recorded in your Order. Your district and industry will be named in your Order.

While your Engagement is running, and for as long as a Growth Plan continues, we will not take on another Client in the same industry in the same district. Exclusivity does not extend to neighbouring districts, to other industries, or to any period after your Engagement and any Growth Plan have ended. It is not a franchise, a territory licence, or a promise that no other business in your area will have a good website.

An Order is only accepted when we confirm it in writing, and acceptance depends on capacity and on the industry and district still being open.

5. Fees, payment and taxes

5.1 How you pay

Unless your Order says otherwise, project fees are paid in two instalments:

  • 50% on order — due before work begins. This is your first payment, and the Project Start Date follows it.
  • 50% on launch approval — due when you approve the site for Launch.

Growth Plan fees are billed monthly in advance. All amounts are in US dollars unless the Order says otherwise, and are payable by the methods we offer through Stripe. You pay any transfer, card or currency conversion charges your own bank or provider applies.

5.2 Late payment and non-payment

Invoices are due on the date stated. If an invoice is more than 7 days late we may suspend work, withhold Launch, and pause any guarantee period until it is paid, and we may charge interest at 1.5% per month on the overdue amount or the maximum the law allows, whichever is lower. Time lost to a suspension does not count against any deadline we have committed to.

If you raise a chargeback or payment dispute instead of contacting us first, we may suspend work and treat the Order as terminated by you under section 19.

5.3 Taxes

Prices exclude taxes. You are responsible for any VAT, sales, withholding or similar tax that applies to the supply in your own country, and for any tax you are required to withhold, which does not reduce what we are owed. Where UAE VAT applies, we will charge it and show it on the invoice.

5.4 Third-party costs you pay directly

Some things a live site needs are bought in your own name and paid by you, not by us. These include your domain registration, your website hosting or site plan, and any paid third-party tool, font, stock photograph, booking system, email service or advertising spend your site relies on. We will tell you what is needed before you commit. If you cancel or let one of these lapse, your site may stop working, and we are not responsible for that or for any deadline or guarantee affected by it.

6. Timeline and the launch window

We will publish your site within 10 Business Days of the Content Complete Date, provided you meet your obligations in section 7 and respond to approval requests inside the windows below.

The clock starts at the Content Complete Date, not at the Order. It pauses whenever we are waiting on you — for content, access, an answer, an approval or a payment — and restarts when we have what we asked for.

We will ask you to approve work at defined points. If you do not respond to an approval request within 3 Business Days, we may treat the item as approved and continue, so the project is not held up.

We aim to reply to your messages within 8 hours on Business Days. This is a service commitment we take seriously, not a guarantee with a financial remedy.

7. What you have to do

7.1 Content and access

So that we can build your site, you will give us, promptly and in a usable format:

  • your text, service and pricing information, photographs, logo and brand files;
  • the details you want shown — name, address, phone, hours, service area, booking rules;
  • access to the accounts the project needs: your domain registrar, hosting, Google Business Profile, analytics, review and social accounts;
  • one named person with authority to answer questions and approve work.

7.2 Your content, your responsibility

You confirm that you own, or have permission to use, everything you send us, and that we may use it to build and run your site. You are responsible for whether your content is lawful, accurate and compliant with the rules of your profession and your market — including advertising rules, health and medical claim rules, licensing and disclosure requirements, real-estate and financial promotion rules, and consumer-protection law wherever your customers are. We write copy to sell your services; we do not verify your claims, your credentials, your prices or your regulatory position, and we are not your compliance adviser.

7.3 Cooperation

You will not instruct another agency, developer or contractor to change the site we are building without telling us, and you will keep tracking, analytics and booking functionality in place during a guarantee period. Section 7 obligations matter: a failure to meet them can delay your project and can affect a guarantee, as set out in the Guarantee Terms.

8. Revisions and changes of scope

Your Plan includes the revisions described in your Order. We will make reasonable adjustments to the work we have delivered so it matches what was agreed.

A change to the agreed scope — extra pages, a new feature, a different structure, a redesign of work you have already approved, or content supplied after the Content Complete Date — is a change of scope. We will quote it before doing it, and it may change the price and the timeline. Nothing in this section requires us to accept a change of scope.

9. The 90-day Engagement and what happens afterwards

The Engagement runs for 90 days from the Project Start Date, not from Launch. During it we build and launch your site, set up what your Plan includes, and report on the enquiries the site produces.

When the 90 days end, the site and everything else we set up stay yours, and you can continue to run it yourself. We are not obliged to provide further work, support, updates, hosting management or reporting after the Engagement unless you buy a Growth Plan or we agree something else in writing.

10. Hosting, maintenance and security

Unless your Order says otherwise, we do not host your site, manage its hosting account, monitor it, back it up or maintain it after the Engagement. Keeping your hosting, domain and third-party tools active and paid for, and keeping your own account credentials secure, is yours to do.

11. Intellectual property

11.1 What stays ours

We keep all rights in our own pre-built industry templates, our design systems, layouts, components, code, methods, documentation, dashboards and internal tooling, and in anything we develop for general use. Nothing in these Terms transfers those rights to you.

11.2 What you get

Once we have received payment in full, we grant you a perpetual, worldwide, non-exclusive, non-transferable, non-sublicensable licence to use, display, operate and modify the Deliverables for your own business.

You may not resell, redistribute, licence, sublicense or publish the template, design system or code as a template, theme, product or starter file, or use them to build sites for anyone else. If you sell your business, the licence may transfer to the buyer of that business with our written consent, which we will not unreasonably withhold.

11.3 Copy and content written for you

Once we have received payment in full, the page copy and written content we produce specifically for your site becomes yours, and we assign to you the rights in it. This does not cover our underlying templates, structures, systems or know-how, which section 11.1 governs.

11.4 Your content

You keep all rights in the content you give us. You grant us a licence to use it to build, launch, operate, measure and support your site, and — subject to section 12 — to show the work we did.

11.5 Third-party assets

Fonts, stock photography, icons, plugins and third-party services included in your site are licensed by their owners on their own terms, which pass through to you. Some need a paid licence in your own name. We will tell you which.

11.6 Our website

Everything on zafremedia.com — text, design, images, code and our name and logo — belongs to us or our licensors. You may view it and share a link to it. You may not copy, scrape, republish, mirror or build a derivative of it, or use automated means to extract content from it, without our written permission.

12. Showing our work

We may show the work we did for you — screenshots, before-and-after comparisons, a live link, the industry and area, and the results we measured — in our portfolio, on our website, in case studies and in our marketing. If you would rather we did not, tell us in writing at hello@zafremedia.com and we will stop. We will not disclose anything you marked confidential under section 15.

13. Third-party platforms, and what we do not promise

Your site depends on services we do not own or control, including Webflow, Google, Meta, LinkedIn, your domain registrar, your booking tool and your payment provider. We are not responsible for their outages, bugs, pricing changes, policy changes, account suspensions or decisions, or for anything that stops working because one of them changed.

In particular, and except for the specific commitments in our Guarantee Terms, we do not promise:

  • any particular position in Google or any other search engine;
  • that your business will be mentioned or recommended by any AI assistant, chatbot or answer engine;
  • any particular number of visitors, enquiries, bookings, customers, revenue or return;
  • that any third-party platform will approve, keep or display your profile, listing, page or advert;
  • that your site will be free of every error, or compatible with every browser, device or future version of either.

Where we describe outcomes elsewhere — on our website, in a landing page, in a message or on a call — those are illustrations of what our work aims at, not warranties, and the only outcome commitments we make are the ones in the Guarantee Terms.

14. Acceptable use of our website

You may not use zafremedia.com to break the law, to send us malware, to attempt to gain unauthorised access to it or to any system connected to it, to interfere with its operation, to scrape it at scale, to submit false or impersonating information through a form, or to send us unsolicited commercial messages. We may restrict or block access to anyone who does.

15. Confidentiality

Each of us may learn non-public information about the other — pricing, plans, numbers, credentials, customer data, methods. Each of us will keep the other's confidential information in confidence, use it only for the project, protect it with reasonable care, and share it only with people and subcontractors who need it and are under equivalent obligations. These duties last for 3 years after the Engagement ends, and indefinitely for anything that is a trade secret or personal data.

They do not apply to information that is public through no fault of the receiver, was already known to the receiver, is independently developed, or must be disclosed by law — and in that last case only to the extent required, with notice to the other where it is lawful to give it.

16. Warranties and disclaimers

We warrant that we will perform the services with reasonable skill and care, by suitably skilled people, and that we have the right to grant the licence in section 11.2.

Beyond that, and beyond the Guarantee Terms, the Deliverables and our website are provided "as is" and "as available", and to the fullest extent the law allows we exclude all other warranties, conditions and representations, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, non-infringement or uninterrupted availability.

17. Limitation of liability

Nothing in these Terms limits liability that cannot lawfully be limited, including liability for fraud or fraudulent misrepresentation, or for death or personal injury caused by negligence.

Subject to that:

  • Neither of us is liable to the other for loss of profit, loss of revenue, loss of anticipated savings, loss of business, loss of goodwill or reputation, loss or corruption of data, or any indirect or consequential loss, however it arises.
  • Our total liability arising out of or in connection with an Order, whether in contract, tort (including negligence), misrepresentation, restitution or otherwise, is limited in aggregate to the total fees you have paid us under that Order in the 12 months before the event giving rise to the claim.
  • Any amount we pay you under the Guarantee Terms counts towards that cap.
  • Our total liability for anything connected with your use of zafremedia.com, where you are not a Client, is limited to US$100.

These limits reflect the price of the services and the allocation of risk both of us have agreed.

18. Indemnity

You will indemnify us against any claim, loss, damage, cost or expense (including reasonable legal fees) arising from: content or material you gave us; your use of the Deliverables after Launch; your breach of section 7.2; or a third party's claim that your content, claims, products or services infringe its rights or break the law.

19. Term, suspension and termination

These Terms apply from when you first use our site or place an Order, and continue until the Engagement and any Growth Plan end.

Either of us may terminate an Order immediately on written notice if the other commits a material breach and does not fix it within 14 days of being told, becomes insolvent, or stops trading. We may also suspend work or terminate if an invoice is overdue under section 5.2, if you will not give us what section 7.1 needs after 30 days of asking, or if you are abusive to our team.

On termination:

  • you pay for all work done up to that date, and for any committed third-party cost we incurred for you;
  • fees already paid are not refundable, except where the Guarantee Terms give you a refund;
  • once you have paid what is due, the licence in section 11.2 applies to what we delivered, and we will hand over the Deliverables as they stand, together with access to your own accounts;
  • sections 11, 12, 15, 16, 17, 18, 20, 23 and 24 survive.

If you cancel after the Project Start Date but before Launch, your first payment covers the work already done and is not refundable, except under the Guarantee Terms.

20. Force majeure

Neither of us is in breach for a delay or failure caused by something outside our reasonable control — including internet or hosting failure, a third-party platform outage, government action, sanctions, war, civil unrest, natural disaster, epidemic, or a general failure of power or telecommunications. Deadlines and guarantee periods pause for as long as the event lasts. If it lasts more than 60 days, either of us may terminate the affected Order without further liability, and you pay for work already done.

21. Compliance with laws

Each of us will comply with the laws that apply to it, including applicable anti-bribery, anti-money-laundering, export control, sanctions and data protection laws. Each of us confirms that it is not subject to a sanctions regime that would make this contract unlawful, and will tell the other promptly if that changes. If performing an Order would put either of us in breach of such a law, that Order may be suspended or terminated without liability, and amounts paid for work not yet done will be returned.

22. Subcontractors and our team

We may use employees, contractors and subcontractors to perform the services. We remain responsible to you for the work they do, and they are bound by confidentiality obligations equivalent to section 15.

23. Notices

Formal notices under these Terms are given by email — to us at hello@zafremedia.com, and to you at the email address in your Order — and are treated as received on the next Business Day after sending, unless the sender gets a delivery failure.

24. General

  • Order of precedence. If there is a conflict, your signed Order comes first, then the Guarantee Terms, then these Terms, then anything else.
  • Entire agreement. Together, those documents are the whole agreement between us about the services, and they replace anything said or written beforehand. Neither of us relies on any statement not written in them, except where it was made fraudulently.
  • Changes. We may change these Terms for new Orders and for use of our website, and the new version applies from the date shown at the top. We will not change the terms of an Order you have already placed without your written agreement.
  • No partnership. Nothing here creates a partnership, joint venture, agency or employment relationship between us.
  • Assignment. You may not assign or transfer your rights under an Order without our written consent. We may assign ours to a successor to our business.
  • Severability. If a provision is found unenforceable, the rest stays in force and the provision is read down to the minimum extent needed to make it enforceable.
  • No waiver. A delay or failure to enforce a right is not a waiver of it.
  • No third-party rights. No one who is not a party to these Terms can enforce them.
  • Language. These Terms are written in English. If we provide a translation, the English version governs.

25. Governing law and disputes

These Terms, and any dispute arising out of or in connection with them or with any Order, are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai, without regard to conflict-of-laws rules.

If a dispute arises, each of us will first try in good faith to resolve it by discussion, within 30 days of one telling the other in writing. If that fails, the courts of Dubai, United Arab Emirates have exclusive jurisdiction. Either of us may still seek urgent injunctive relief in any competent court to protect its intellectual property or confidential information.
